Exide Technologies Redacted Filings Approved

According to the U.S. Bankruptcy Court docket, the Court issued an order authorizing Exide Technologies to (I) file redacted versions of its limited objection to the official committee of unsecured creditors’ motion to retain Quinn Emanuel Urquhart & Sullivan as special antitrust counsel and (II) declaration of Wendy Huang Waszmer in support of the Debtor’s limited objection.

As previously reported, “The Debtor submits that the Court should permit the Debtor to file redacted versions of the limited objection and Waszmer Declaration because they contain commercial information that is subject to the Common Interest and Confidentiality Agreement, and therefore has not been disclosed to other parties or otherwise filed on the docket. Confidential commercial information is information that would result in an unfair advantage to competitors by providing them information as to the commercial operations of the [entity seeking the protective order].”

The motion continues, “Specifically, the limited objection and Waszmer declaration include a summary of fee applications submitted by the Economic Consultant, which to date have been filed under seal.”  The Company emerged from a previous bankruptcy in 2004, making this proceeding a “Chapter 22.” Read more about XIDE’s current Chapter 11 case.
